2026 Tax Auction Information

IMPORTANT - FOR PARCELS SOLD AT THE SEPTEMBER 2026 TAX FORECLOSURE AUCTION

PLEASE READ — INFORMATION REGARDING POTENTIAL SURPLUS FUNDS

Pursuant to the New York State Real Property Tax Law (RPTL), Article 11, the following applies to parcels sold at the September 2026 tax foreclosure auction:

1. AUCTION PURCHASERS MUST PAY IN FULL BY OCTOBER 16, 2026.

Bidders who purchased property at the September 2026 auction have until October 16, 2026 to pay the remaining balance due in full.

2. AFTER PAYMENT, THE TREASURER WILL DETERMINE WHETHER THERE IS A SURPLUS.

Once the purchase price has been paid in full, the Sullivan County Treasurer will determine whether the sale resulted in a surplus, and, if so, the amount of that surplus, in accordance with NYS RPTL § 1196.

The Treasurer will then prepare and submit a Report of Surplus and proposed Order to the Court for review and approval.

3. FORMER OWNERS AND OTHER INTERESTED PARTIES WILL BE NOTIFIED.

If a surplus exists, the former owner and other interested parties will receive notice concerning the surplus and the procedure for making a claim, as provided by NYS RPTL §§ 1196 and 1197.

If your mailing address has changed, please contact the Sullivan County Treasurer’s Office at 845-807-0200 and provide your current mailing address.

Providing an updated address will help ensure that notices concerning any surplus are mailed to the correct address.

4. THE PROCESS MAY TAKE UP TO 60 DAYS OR LONGER.

Please be advised that the process of completing the sale, determining and reporting any surplus, obtaining Court approval, and providing the required notices may take up to approximately 60 days from the date of the auction, or longer if Court action or other circumstances cause a delay.

5. WHAT HAPPENS IF THE SUCCESSFUL BIDDER DOES NOT PAY?

If a successful bidder fails to pay the remaining balance by October 16, 2026, the bidder will be considered in default and the bidder's down payment will be forfeited in accordance with the auction terms.

The parcel will then be scheduled for a subsequent auction later this year.

A bidder's failure to complete the purchase may delay the determination and distribution of any surplus relating to that parcel.

PLEASE NOTE: A surplus is not guaranteed. The existence and amount of any surplus will be determined in accordance with the New York State Real Property Tax Law and subject to the applicable Court proceedings.
