DA Conaty Announces Indictment for Predatory Sexual Assault Against a Child

Monticello, NY - On January 13, 2026, Sullivan County District Attorney Brian P. Conaty announced that a Sullivan County Grand Jury has returned an eight-count indictment charging Joseph Wallace, 51, of Liberty, with three counts of Predatory Sexual Assault Against a Child, class A-II felonies, Rape in the Third Degree, a class E felony, and four counts of Endangering the Welfare of a Child, class A misdemeanors, stemming from allegations of sexual abuse of a minor. 

As alleged in the indictment, in 2010, Wallace engaged in two acts of vaginal sexual intercourse with a child who was less than thirteen years old; between 2012 and 2017, Wallace engaged in two or more acts of sexual conduct, including at least one act of vaginal sexual intercourse, with a child less than thirteen years old; and in 2020, Wallace engaged in one act of vaginal sexual intercourse with a female who was less than seventeen years old. 

Wallace faces life in prison if convicted as charged. Due to the nature of the allegations and to protect the privacy of the victim, no additional identifying details will be released. 

This investigation was conducted by the New York State Police Child Abuse Unit in collaboration with Child Protective Services. Wallace was arrested on September 16, 2025, and was remanded to the Sullivan County Jail without bail by Judge Robert Scheinman of the Town of Fallsburg Justice Court pending further proceedings.

Conaty said: “This indictment reflects our office’s commitment to holding offenders accountable and protecting the children of our community. Child sexual abuse cases are among the most serious we prosecute, and we will pursue justice while ensuring the dignity and privacy of the victim are respected.”

The filing of an indictment is merely an accusation and the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
